Drowning accidents can happen at anytime to anyone, but they are often preventable. It is the responsibility of all pool owners to install and maintain safety features that keep visitors safe. There are a number of types of protection that are required by law and many other preventive measures that are recommended but not legally mandated. All these layers of protection should be considered if you have a swimming pool in your backyard.

Yards that have a pool must have an outer fence that prevents visitors from entering the property. In California, pool owners must also have a fence, wall, or other barrier that partitions a swimming pool from the home. This means that an outer fence surrounding the yard is not sufficient. Pool owners must have a barrier that specifically surrounds the pool. That barrier must have a self-closing, self-latching device with a release mechanism that is at least 54 inches above the floor or ground. This way, the barrier will be closed and young children will not be able to enter the pool area.

Homeowners would be well advised to consider purchasing multiple alarms as well. You must install an exit alarm on the doors leading to your backyard. This way, you will be made aware if a child opens the door. Close supervision is another important layer of protection that should be available for young swimmers at all times.

No one should swim alone and children should never be allowed in a pool area without an adult. Furthermore, anyone monitoring the pool should know CPR. These preventive measures can greatly reduce the probability of a drowning or near-drowning. Anyone who has been injured or has lost a loved one in a swimming pool accident would be well advised to contact an experienced San Jose personal injury lawyer to further examine their legal rights and options.
