After bringing forth a slip and fall lawsuit against a property owner, general contractor, subcontractor, and employer for failing to maintain a safe work environment for our client, our team at Caputo and Van Der Walde – Injury & Accident Attorneys obtained a favorable settlement in the amount of our client’s full and fair compensation.
About the Case
In this lawsuit, our acclaimed San Jose attorneys represented a foreman/carpenter who slipped and fell in a concrete slurry at a construction site, which a subcontractor negligently left behind. This slurry was about six feet square and 18 inches deep, without any barricades, tape, or other warnings around it.
At the time of the accident, our client was working on a project to add a second story to an existing campus structure. The parties in charge of the project disregarded the safety of our client, as well as that of other workers there, by failing to warn of the slurry’s presence. As a result, our client sustained a massive full thickness rotator cuff tear that continues to negatively impact his life almost a decade later. Medical professionals have told him that he can no longer work in construction.
Although legal action cannot turn back time and prevent our client’s accident from happening, the settlement we obtained on his behalf allows him to make up for any losses related to the accident. Most importantly, he will be able to afford the medical treatment he needs and deserves.
To protect the privacy of all parties involved, the details of this settlement are confidential.
