Campbell Wrongful Death Attorneys
Advocating for the Loved Ones of Wrongful Death Victims for 85+ Years
A wrongful death case is a civil action brought against an at-fault party whose actions and negligence resulted in the wrongful and untimely death of a person. Although the claim process varies by state, generally speaking, wrongful death claims can only be filed by the victim’s surviving loved ones, such as spouses, children (minor or adult), or parents. The wrongful death could have happened during a train, boat, car, or truck accident, or even as a result of carbon monoxide exposure.

Do I Qualify for Compensation?
We know that financial compensation cannot replace a loved one, but it can help surviving family members deal with the expenses the death has incurred.
To be eligible to file a claim for wrongful death, you must be related to the deceased party in one of the following ways:
- Surviving spouse or domestic partner
- A dependent but not legal spouse
- Adopted or biological children
- Stepchildren
- Parent or parents
- Dependent minors in the victim’s household
- Grandparent, sibling, or other intestate heir
- A person with another type of dependent relationship to the victim
There are, however, some limitations to filing a wrongful death claim. Primarily, the state of California gives you two years after the date of your loved one’s death to begin the pursuit of a wrongful death claim. If the death was due to medical malpractice, you have three years from the date of the injury or death or one year after you discover, or can be reasonably expected to discover, the injury or death — whichever occurs first. On the other hand, government liability cases give only six months from the date of injury to file a claim.
Due to these time limitations, and potential for other time limitations, it is important to reach out to a knowledgeable attorney immediately.
The damages you can recover for a wrongful death lawsuit may include the following:
- Loss of love, care, companionship, comfort, affection, protection, and consortium
- Loss of training, advice, nurturing, and mentorship
- Loss of financial support, contributions and services
- Medical costs related to the death
- Burial and funeral expenses
- Pain and suffering
Compensation is also dependent on the wrongfully deceased’s life expectancy, as well as the relationship you had with them. For instance, if the victim was your spouse of 35 years or your mother who you were very close with, it is likely the court or jury will scale up the compensation higher than it would for a distant great uncle.
