Fatal San Jose Car Crash Claims Two Lives, Injures Another

By San Jose Personal Injury Lawyer on November 4, 2010 - No comments

A fatal San Jose car accident took the lives of two women, news outlet KLIV.com reports. Another person was also injured. The crash occurred early Saturday morning, October 30, near the off-ramp for Blossom Hill Road on U.S. 101 southbound in San Jose.

The solo-vehicle accident occurred when the car veered off the road and struck a tree, throwing one woman from the motor vehicle. Along with another female victim, the woman was pronounced dead at the scene of the fatal San Jose car crash. Another passenger in the vehicle was taken to a local hospital, the extent of their injuries not known at this time. Authorities are investigating the cause of the deadly San Jose car accident.

According to the National Highway Traffic Safety Administration (NHTSA), 33,808 people lost their lives in car crashes in the United States in 2009. Of those deaths, 23,382 were individuals who were either occupants or drivers in passenger vehicles. Another 2.2 million people were estimated to have been injured in car accidents in 2009.

That same year, 3,081 people died in car crashes in California; the highest number of deaths per state in the U.S.

There are many situations that can cause a fatal California car accident. Driving under the influence of drugs or alcohol; driving distracted; swerving to avoid colliding with another vehicle; and excessive speeding can cause a car crash. If the negligent behavior of another driver is to blame for a car collision, a victim of such an accident may be able to receive monetary compensation for medical expenses, vehicle repairs, loss of present and future income, and more.

If you have been injured in a Northern California car collision and believe it was the result of the negligence of another driver, it may be a good decision to consult with a personal injury attorney. San Francisco to Charge Auto Accident-Causing Motorists a Cleanup Fee

By San Jose Personal Injury Lawyer on October 12, 2010 - No comments

By mid-October, San Francisco will be the first major city in California to implement what is referred to as a “first-responder fee.” According to an article on SFExaminer.com, the controversial fee charges accident-causing motorists up to $500 for cleanup related to the crash, recovering the cost of a fire department cleanup. Only a motorist who is found at fault will be charged the fee, not all motorists involved. The goal is to charge the driver’s insurance company.

Currently, the San Francisco Fire Department has a $13 million deficit. The first-responder fee is expected to raise about $626,000 a year, closing the deficit within a few years of implementation.

The San Francisco Board of Supervisors approved the first-responder fee in July. Other cities across the state and nationwide are adopting, debating, and implementing similar fees. Currently Sacramento is deliberating putting into action a similar penalty for accident-causing motorists. In southern California, Huntington Beach endorsed a fee program in August targeting tourists only, but the City Council rescinded the fee in late September after being flooded with complaints.

According to the National Highway Traffic Safety Administration (NHTSA), there were over 6 million car crashes reported to law enforcement in 2005, resulting in over 2.7 million injuries.

The criminal justice system can punish the negligent driver in a California car accident, but cannot do anything to compensate victims for injuries sustained in the crash. Often, victims are saddled with costly medical expenses, hospital bills, vehicle repair, or even a life-changing injury. This can be devastating, resulting in a loss of income for the individual or family, loss of future wages as well as dealing with the emotional and painful suffering a serious injury causes.

If you are injured in a Northern California car accident and believe it was because of another driver’s negligence, you may want to speak with the San Francisco personal injury lawyers at Van Der Walde & Associates. Our highly skilled Northern California auto accident attorneys will work to hold the negligent parties who caused the accident and your injury accountable, and will seek compensation for damages on your behalf. Car Accident Costs in the U.S. Estimated at $230 Billion Annually

By San Jose Personal Injury Lawyer on September 8, 2010 - No comments

The costs associated with a San Jose car accident can vary greatly, and can depend on the amount of vehicle damage that occurs, whether or not people involved are seriously injured, and whether or not injury victims are negatively impacted by their injuries in the long term. While the initial costs associated with an accident may not always necessarily be high, particularly if there isn’t much damage done to the vehicles involved, the long term costs can certainly add up quickly. According to a recent Mercury News article, the cost of motor vehicle accidents averages out to an astonishing $500 per licensed driver in the United States. This figure represents not just those drivers involved in crashes, but an average of all drivers across the country.

Reportedly, facts and figures from 2005 gathered by the Centers for Disease Control and Prevention show that the costs associated with personal injury alone account for more than $99 billion annually in the United States. Factor in additional insurance costs, and the number more than doubles, coming in at $230.6 billion. Unfortunately, theses staggering amounts serve as indication that reckless driving practices and negligence are to blame for far too many auto accidents each year.

Car accidents are currently the ninth leading cause of death worldwide, but are on pace to become the fifth leading cause by the year 2030. In the U.S., it is speculated that lax traffic laws are to blame for the high number of accidents that take place nationwide. While California does have some of the strictest regulations in the country, motorists still disregard the rules of the road, putting not only themselves in harm’s way but all other drivers on the road as well.

In the event that you are injured in a San Jose car accident due to the negligence of another, it would be in your best interest to contact the personal injury law firm of Van Der Walde & Associates. Our experienced San Jose car accident attorneys will hold negligent parties who contributed to your accident accountable for their actions, seeking compensatory damages on your behalf. Reckless Driver Runs Red Light, Injures Family and Kills 15-Year-Old

By San Jose Personal Injury Lawyer on July 16, 2010 - No comments

According to the San Jose Mercury News, what would have been a minor traffic stop turned into a San Jose car crash when a motorist attempted to flee police, ran a red light, and struck another vehicle, injuring a mother and her three children. Reportedly, the driver made an illegal right-hand turn at a red light, prompting a nearby police cruiser to take pursuit. Rather than stopping his vehicle though, the 24-year-old driver attempted to evade police, recklessly maneuvering his vehicle before striking the vehicle being driven by the 35-year-old mother.

Both drivers, along with a female passenger in the 24-year-old male’s car, sustained minor to moderate injuries. However, the impact was great enough that it practically tore the 35-year-old mother’s vehicle in half, and launched her 15-year-old daughter out of the car and into traffic. The 15-year-old was unable to recover from her injuries. At the time of this report, the woman’s 12 and 6-year-old sons, both passengers in the backseat, are listed in stable condition.

Senior Drivers May Be Safer than Teens, but Accidents Can Happen to Anyone

By San Jose Personal Injury Lawyer on May 26, 2010 - No comments

There seems to be a definite reason why so many people associate elder drivers with traveling at a snail’s pace, and teenagers with possessing the need to travel at a higher speed. Statistically speaking, according to a USA Today article, senior drivers are less likely to be involved in auto accidents than other motorists, particularly when compared to the number of accidents associated with teenage drivers. According to the National Highway Traffic Safety Administration (NHTSA), drivers between the ages of 64 and 69 are the safest motorists on the road, while teenage drivers, particularly male drivers, and the most dangerous.

While various measures, such as the graduated driver licensing (GDL) system, have been put into effect to help curb the number of accidents associated with teen driving, proper instruction of safe driving techniques should be at the forefront of all driving instruction across all age categories. After all, traffic accidents are caused by motorists of all ages.

Regardless of how young or old a driver may be, that driver is certainly susceptible to inattention, a disregard for traffic laws, and is capable of causing an accident due to negligent action taken immediately before the Northern California vehicle crash. Fortunately, for accident victims, there is legal recourse that can be taken to help recover monetary damages associated with the accident, such as medical bills and physical therapy fees.
